Jurisdiction determines whether a court has authority to hear a particular dispute. Subject-matter jurisdiction identifies the court type; territorial jurisdiction identifies the proper geographical venue.
Before filing
- Identify each party’s legal capacity.
- Identify the source of the right: contract, tort, property, employment or administrative act.
- Define the exact remedy sought.
- Check for specialized jurisdiction or a valid arbitration clause.
- Apply the current venue rules.
Filing in the nearest court is not necessarily correct. A defendant’s domicile, property location or a special rule may control venue.
